Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of FollowUp's platform and services. By using FollowUp, you agree to comply with this policy. Violations may result in suspension or termination of your account.
1. Prohibited Uses
You may not use FollowUp to:
1.1 Illegal Activity
- Conduct any activity that violates applicable local, state, national, or international law
- Promote or facilitate illegal goods, services, or activities
- Launder money or finance terrorism
- Transmit content that infringes on intellectual property rights
1.2 Spam and Unsolicited Messaging
Zero Tolerance for Spam
FollowUp has a zero-tolerance policy for spam. Sending unsolicited messages to individuals who have not given prior express consent is strictly prohibited and may violate federal law (TCPA), resulting in fines of $500–$1,500 per message.
- Send bulk unsolicited messages (spam)
- Send messages to purchased, rented, or scraped contact lists
- Send messages without proper prior express consent from recipients
- Disguise the origin or intent of your messages
- Use misleading sender information or deceptive subject lines
1.3 Harassment and Harmful Content
- Harass, bully, threaten, or intimidate any person
- Send hateful, discriminatory, or defamatory content
- Distribute sexually explicit or obscene material
- Exploit, harm, or attempt to exploit minors in any way
- Encourage violence or self-harm
1.4 Impersonation and Fraud
- Impersonate any person, business, or entity
- Misrepresent your affiliation with any person or organization
- Engage in phishing, social engineering, or other deceptive practices
- Create fake accounts or use false registration information
1.5 Malware and Security Threats
- Transmit viruses, malware, or other malicious code
- Send messages containing links to malicious websites
- Attempt to gain unauthorized access to FollowUp systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Service
1.6 Scraping and Unauthorized Data Collection
- Scrape, crawl, or spider any portion of the Service
- Use automated tools to access the Service beyond the provided API
- Collect or harvest user data without authorization
- Reverse engineer, decompile, or disassemble any part of the Service
2. SMS and Messaging Compliance
When using FollowUp to send SMS messages, you are responsible for complying with all applicable telecommunications and messaging regulations. This includes but is not limited to:
2.1 TCPA Compliance (United States)
Your Obligations Under the TCPA
The Telephone Consumer Protection Act (TCPA) imposes strict requirements on commercial text messages. As the sender, you are legally responsible for compliance. FollowUp provides tools to help, but does not assume your compliance obligations.
- Prior Express Consent: Obtain documented consent from each recipient before sending messages. For marketing messages, prior express written consent is required.
- Opt-Out Handling: Honor all opt-out requests immediately. Recipients must be able to reply STOP (or similar keyword) to opt out at any time.
- Identification: Clearly identify yourself or your business in each message.
- Quiet Hours: Do not send messages before 8:00 AM or after 9:00 PM in the recipient's local time zone.
- Record Keeping: Maintain records of consent for at least four (4) years.
2.2 CAN-SPAM Compliance
- Do not use false or misleading header information
- Do not use deceptive subject lines
- Include a valid physical address or registered P.O. box
- Process opt-out requests within 10 business days
2.3 International Messaging
If you send messages to recipients outside the United States, you must comply with all applicable local regulations, including but not limited to GDPR (EU), CASL (Canada), and the Privacy Act (Australia).
3. Account Abuse
- Rate Limit Evasion: Do not attempt to circumvent rate limits by creating multiple accounts, rotating API keys, or using other workarounds.
- Credential Sharing: Do not share your account credentials with unauthorized parties. Each user must have their own account.
- Resource Abuse: Do not use the Service in a way that consumes disproportionate resources or degrades the experience for other users.
- API Abuse: Do not use the API in ways that exceed documented rate limits or for purposes not intended by the Service.
4. Consequences of Violations
Violations of this Acceptable Use Policy may result in:
- Warning: For minor or first-time violations, we may issue a warning and request corrective action.
- Temporary Suspension: Your account may be temporarily suspended while we investigate a reported violation.
- Permanent Termination: Serious or repeated violations will result in permanent account termination without refund.
- Legal Action: We reserve the right to pursue legal remedies for violations that cause harm to FollowUp, our users, or third parties.
Immediate Termination
The following will result in immediate account termination without warning: sending spam, distributing malware, engaging in phishing, transmitting illegal content, or any activity that poses a security threat to our platform or users.
5. Reporting Abuse
If you believe someone is using FollowUp in violation of this policy, or if you received an unwanted message sent through our platform, please report it to us.

We investigate all reports and will take appropriate action. You can also forward any unwanted SMS messages to us for investigation.
6. Changes to This Policy
We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email or a notice within the Service. Continued use of FollowUp after changes take effect constitutes acceptance of the updated policy.
